什么病属于职业病?职业病可以申请工伤吗?

根据我国(guo)2011年1月1日实行的(de)新修订的(de)《工伤保险条例》第十四(si)条规定,职(zhi)工有下列情形(xing)之一(yi)的(de),应当认(ren)定为工伤:

(一)在工作时间和工作场所(suo)内,因工作原因受(shou)到事故伤害的。

(二(er))工(gong)(gong)(gong)作(zuo)时间前(qian)后在工(gong)(gong)(gong)作(zuo)场所(suo)内(nei),从事与工(gong)(gong)(gong)作(zuo)有(you)关的预备(bei)性(xing)或者收尾性(xing)工(gong)(gong)(gong)作(zuo)受(shou)到事故伤(shang)害的。

(三)在(zai)工(gong)作时间(jian)和工(gong)作场所内(nei),因履行工(gong)作职责(ze)受到暴力等意外(wai)伤害的。

(四)患(huan)职业病的。

(五)因工外出期间,由于工作原因受到伤害(hai)或(huo)者发生事故下落不明的。

(六)在上下班途中,受到非本(ben)人主(zhu)要责任的交通(tong)事(shi)故(gu)或者城市轨道交通(tong)、客运轮渡(du)、火车事(shi)故(gu)伤害的。

(七)法律、行政法规规定应(ying)当认(ren)定为(wei)工伤的其他情(qing)形。


中(zhong)国卫疾(ji)控发[2013]48号(hao)印发的《职(zhi)(zhi)(zhi)业(ye)(ye)病(bing)分类(lei)和(he)目录》规定(ding)的疾(ji)病(bing)是法定(ding)职(zhi)(zhi)(zhi)业(ye)(ye)病(bing),其中(zhong)十大(da)类(lei)职(zhi)(zhi)(zhi)业(ye)(ye)病(bing)分别是:职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)尘肺(fei)病(bing)及(ji)其他(ta)呼(hu)吸系统疾(ji)病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)皮肤病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)眼(yan)病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)耳鼻喉口腔疾(ji)病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)化学(xue)中(zhong)毒、物(wu)理因素所致职(zhi)(zhi)(zhi)业(ye)(ye)病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)放射性(xing)(xing)疾(ji)病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)传染病(bing)、职(zhi)(zhi)(zhi)业(ye)(ye)性(xing)(xing)肿瘤、其他(ta)职(zhi)(zhi)(zhi)业(ye)(ye)病(bing)。

 

如(ru)何申请工伤认定?

根(gen)据《工(gong)伤(shang)(shang)保险(xian)条例》第十(shi)七条规(gui)(gui)定(ding)(ding)(ding)(ding)(ding)(ding),职(zhi)工(gong)发生(sheng)事(shi)故(gu)伤(shang)(shang)害(hai)或(huo)者(zhe)按照职(zhi)业病防(fang)治法规(gui)(gui)定(ding)(ding)(ding)(ding)(ding)(ding)被诊(zhen)(zhen)断、鉴(jian)定(ding)(ding)(ding)(ding)(ding)(ding)为职(zhi)业病,所在(zai)单(dan)位应当自事(shi)故(gu)伤(shang)(shang)害(hai)发生(sheng)之(zhi)日(ri)或(huo)者(zhe)被诊(zhen)(zhen)断、鉴(jian)定(ding)(ding)(ding)(ding)(ding)(ding)为职(zhi)业病之(zhi)日(ri)起30日(ri)内,向统筹地区社会保险(xian)行政部门提(ti)出(chu)工(gong)伤(shang)(shang)认(ren)定(ding)(ding)(ding)(ding)(ding)(ding)申请;用(yong)人(ren)(ren)单(dan)位未按前(qian)款规(gui)(gui)定(ding)(ding)(ding)(ding)(ding)(ding)提(ti)出(chu)工(gong)伤(shang)(shang)认(ren)定(ding)(ding)(ding)(ding)(ding)(ding)申请的,工(gong)伤(shang)(shang)职(zhi)工(gong)或(huo)者(zhe)其近亲属、工(gong)会组织在(zai)事(shi)故(gu)伤(shang)(shang)害(hai)发生(sheng)之(zhi)日(ri)或(huo)者(zhe)被诊(zhen)(zhen)断、鉴(jian)定(ding)(ding)(ding)(ding)(ding)(ding)为职(zhi)业病之(zhi)日(ri)起1年内,可以直接向用(yong)人(ren)(ren)单(dan)位所在(zai)地统筹地区社会保险(xian)行政部门提(ti)出(chu)工(gong)伤(shang)(shang)认(ren)定(ding)(ding)(ding)(ding)(ding)(ding)申请。

提出工伤认定申请应当提交下(xia)列材料:

1、工伤认定(ding)申请表(biao);

2、与用人单位存在(zai)劳动(dong)关(guan)系(包括事实劳动(dong)关(guan)系)的证(zheng)明(ming)材料;

3、医疗诊断(duan)证明或者职业病诊断(duan)证明书(shu)(或者职业病诊断(duan)鉴(jian)定(ding)书(shu))。

 

包括(kuo)采用(yong)有效的职(zhi)(zhi)业(ye)(ye)病防(fang)护设施、保(bao)证(zheng)工作(zuo)场所符合职(zhi)(zhi)业(ye)(ye)卫(wei)生(sheng)要求、佩(pei)戴防(fang)护用(yong)品、定期进行职(zhi)(zhi)业(ye)(ye)病危害检(jian)测、职(zhi)(zhi)业(ye)(ye)健(jian)康体检(jian)、职(zhi)(zhi)业(ye)(ye)卫(wei)生(sheng)培训等等,以预防(fang)、控制和消除职(zhi)(zhi)业(ye)(ye)病危害,防(fang)治(zhi)职(zhi)(zhi)业(ye)(ye)病,保(bao)护劳动者健(jian)康,促进企业(ye)(ye)的经济(ji)发展,实现职(zhi)(zhi)业(ye)(ye)健(jian)康安全目标。
